Power of Attorney Signings with Witnesses
In short: In Florida, a power of attorney must be signed by the principal in front of two witnesses and acknowledged before a notary (§ 709.2105). We travel to the principal, at home, in a hospital or in a care facility, and make sure the signing meets those formalities so the document is accepted when it is needed.
Step 1
What does a notary do on a power of attorney?
On a Florida power of attorney, the notary verifies the principal's identity, confirms that the principal understands the document and is signing willingly, and completes the acknowledgment certificate, while two witnesses watch the principal sign.
A power of attorney lets someone you trust, the agent, act for you: pay bills, manage bank accounts, sell a house, deal with insurance. Families usually need one in a hurry, when a parent is going into surgery, a relative is moving abroad, or an owner cannot be at a closing. Banks and title companies are strict about how it was signed, and a missing witness signature is enough for them to refuse it.
We do not decide what powers to grant or write the legal terms for you; that is the job of you and, if you want advice, an attorney. What we do is make the signing itself right: the principal, two qualified witnesses and the notary together, every page complete, and the special powers that Florida requires to be initialed actually initialed.
- Durable financial powers of attorney (Chapter 709)
- Limited powers for a single transaction, such as a closing
- Health care surrogate designations and living wills
- Self-proving affidavits for wills (§ 732.503)
- Revocations of a previous power of attorney
Step 2
What do we need for a power of attorney signing?

Step 5
Frequently asked questions
Does a power of attorney need witnesses in Florida?
Yes. Section 709.2105 requires the principal to sign in front of two subscribing witnesses and to acknowledge the signature before a notary. Without both witnesses, a bank or title company can refuse to honor the document. We help you plan who the witnesses will be before the appointment.
Can you notarize a power of attorney in a hospital?
Yes, as long as the principal is alert, understands what the document does and can communicate that they want to sign it. Hospital staff usually cannot act as witnesses because of their own policies, so arrange two other adults or ask us in advance. If the patient's condition changes and capacity is unclear, the notary must stop.
Can my mother sign a power of attorney if she only speaks Spanish?
Yes. The notary must be able to communicate directly with the signer, and because we are bilingual we can do that in Spanish. The principal should understand the document's content; if it is in English, consider having it translated or reviewed with someone she trusts before the signing day.
What are the powers that must be initialed?
Florida requires the principal to sign or initial next to certain powers for them to be valid, such as creating or changing a trust, making gifts, changing beneficiary designations or waiving survivorship rights. If the document has those sections, the notary will make sure the principal initials them at the signing. Whether to include them is a decision for you and your attorney.
Is a power of attorney from another state valid in Florida?
Generally yes, if it was valid where it was signed. In practice, Florida banks and title companies are more comfortable with a document that follows Florida formalities. If you are moving here or own property here, signing a Florida version is often the simplest route.
Can you also notarize the self-proving affidavit of a will?
Yes. A will signed with a self-proving affidavit lets the court accept it without contacting the witnesses later. The testator and both witnesses sign the affidavit in front of the notary. We notarize it; we do not draft the will.
